Establish the questions requiring expert assessment, the available evidence and the proposed scope.
Review programmes, updates, progress information, correspondence and other relevant contemporaneous records.
Identify an appropriate analytical approach and explain its basis, assumptions and limitations.
Consider the relationship between delay events, affected activities, critical paths and completion.
Prepare clear findings supported by evidence, distinguishing facts, assumptions and professional judgement.
BEFORE AN APPOINTMENT
Once the principal issues and likely evidence requirements can be identified, allowing scope, conflicts and availability to be considered early.
Subject to appointment and conflicts, FPEP can review the programme analysis, evidence, assumptions and alternative explanations supporting a claim.
The appropriate methodology depends on the questions being examined, the available project records and the limitations of the evidence. No single method is necessarily suitable for every dispute.
Stephen has experience providing written and oral expert evidence in international arbitration. Proposed appointments are considered individually.
